WARREN Terms and Conditions

These WARREN Terms of and Conditions (“Terms”) apply each time you use the WARREN service (the “Chatbot”). By using the Chatbot, you are deemed to have agreed to these Terms.

In these Terms, “Group of Companies”, “we” and “our” refer to The Alberta New Home Warranty Program, The New Home Warranty Insurance Canada Corporation and The Canadian Home Warranty Protection Program, or any of them. “You” and “your” refer to a user of the Chatbot.

Your use of the Chatbot indicates that you understand and agree to these Terms. You also agree and understand that any other agreements, terms, conditions or exclusions that apply to any products and services that you may have with the Group of Companies will also continue to apply when you use the Chatbot.

In the event of any inconsistency between the information provided by the Chatbot and the terms, conditions, agreements, exclusions or legislation applicable to any products or services you have with the Group of Companies, those terms, conditions, agreements, exclusions or legislation shall govern.

1. The Chatbot Service

The Chatbot uses artificial intelligence to respond to certain questions that you ask about the Group of Companies, including general inquiries about products and services and frequently asked questions.

The Chatbot is provided by a third-party vendor and is available on the Group of Companies website.

2. Use and Functionality of the Chatbot

You understand and agree that:

  • Chatbot responses are for general informational purposes only.
  • Any information provided by the Chatbot is not and should not be considered to be legal advice or a determination of any rights or obligations that you may have pursuant to a home warranty insurance policy or legislation, and it should not be relied upon in that regard.
  • The Chatbot does not have access to your home or your specific home warranty insurance details and will not be able to answer any questions specific to your home warranty insurance policy.
  • The Chatbot cannot be used as a communications method between you and the Group of Companies and cannot be used to submit a claim under your new home warranty insurance policy. Any such claims must be submitted in accordance with the terms of your new home warranty insurance policy.
  • The Chatbot has limited capacity and may not be able to answer your question or provide the information that you are seeking.
  • You are responsible for determining if the response provided by the Chatbot applies to you.
  • The responses the Chatbot provides should not be considered as official statements or responses from the Group of Companies for your specific situation.
  • The Group of Companies is not responsible for any damage or losses that you may suffer as a result of the Chatbot being unable to provide you with the information that you have sought.
  • The Group of Companies is not responsible for any damage or losses that you may suffer as a result of relying on responses provided to you by the Chatbot.
  • We may monitor and/or record the discussion you have with the Chatbot for our protection and your protection and to enhance the quality of the Chatbot and our service.

4. Changes to These Terms

Changes to these Terms may be made by us at any time, without prior notice. The new or revised Terms will be effective and binding on you when we post them on the Group of Companies website. Your use of the Chatbot after we post the notice means that you agree to and accept the Terms as amended.

5. Limitation of Liability

You acknowledge that the Group of Companies will not be liable for any losses or damages that you may suffer as result of your use of Chatbot, including if Chatbot is unavailable for any reason or if the Chatbot is unable to provide you with the information have you sought or has provided information that does not apply to your situation.

The Group of Companies does not warrant the accuracy, adequacy, timeliness, or completeness of the information provided by Chatbot.

Where the information provided by the Chatbot differ from or is inconsistent with the terms of any of the products offered by the Group of Companies or governing legislation, the terms of those products or legislation shall govern.  The Group of Companies shall not be liable for any discrepancy or deviation between the information provided by the Chatbot and the terms of any products or legislation or for any damages arising therefrom.

6. Indemnity

You agree to indemnify and hold harmless the Group of Companies and its directors, officers, employees insurers, agents and assigns, from and against any claims, debts, demands, actions, causes of action or cost (including legal fees on a solicitor and own-client basis) from third party claims arising out of or relating to your use of the Chatbot or any violation of these Terms.

7. Governing Law

These Terms are governed by the applicable laws of the laws of Alberta, and by the laws of Canada applicable therein.
